2. Lerson OÜ – CLAIMS CONSIDERATION PROCEDURE
2.1. With regard to products sold by Lerson OÜ, claims can be submitted during a two-year period, as established by subsection 218 (2) of the Law of Obligations Act.

3. Definitions:
3.1 Expert assessment – the expert assessment carried out by the technical maintenance department of Lerson OÜ (in some cases, by the importing company) for the purpose of establishing the existence and cause of occurrence of a defect detected in the product.
3.2 Independent expert assessment – the additional expert assessment carried out by an independent expert at the demand of the customer for a fee if the customer is not satisfied with the results of the expert assessment held by Lerson OÜ.
3.3. The term for the submission of claims starts on the date when the product is purchased.
3.4. The basis for the submission of a claim is the invoice for the product and a warranty certificate that has been filled out, if the manufacturer asks for its submission.
3.5. A claim can be submitted to the representative office of Lerson OÜ.
3.6. A seller shall not be held liable for the following defects:
3.6.1 Product malfunctions due to damage caused by the user by accident or on purpose;
3.6.2 Equipment malfunctions caused by alterations made in the equipment parameters by a person or a technical servicing point that has not been certified by the manufacturer;
3.6.3 Malfunctions caused by the failure to observe the guidelines provided in the operating manual;
3.6.4 Malfunctions in the operation of the product caused by the use of the product in conditions that the product is not intended to be used in;
3.6.5 Malfunctions in the operation of the product caused by a thunderstorm or any other natural phenomenon (force majeure circumstances);
3.6.6 Malfunctions in the operation of the product caused by the connection of the product to a power network that does not meet the requirements (including an unearthed power network).
3.7. A claim should be submitted in the Estonian language and with a detailed description of a defect (defects) detected in the product.
3.8. A claim is not subject for consideration if Lerson OÜ manages to prove that defects have occurred at the fault of the buyer.
3.9. If any disputes arise, Lerson OÜ undertakes to carry out an expert assessment to determine the reason for the defect detected in the product within six months after the date when the product was sold. If, as a result of the expert assessment, it becomes clear that the defect has occurred due to the client, but the client does not agree to this result, the client has the right to request an independent expert assessment. If the independent expert assessment proves that the defect has occurred due to the client, the expenses for carrying out an independent expert assessment will be covered by the client.

3.10. If the client submits a claim concerning the product after the expiry of six months after the product was purchased, and in the course of repairs, it becomes clear that the product does not have any defects, the client shall cover the expenses incurred.
3.11. If it is impossible to repair a product that is the subject of the claim, or the manufacture of the relevant product has been suspended, Lerson OÜ reserves the right to replace the product with an equivalent one with the client’s consent.

4. Right to withdrawal
4.1. The right to the return of the products purchased at the online store is valid for 14 days.
4.2. The product to be returned to the store should have no defects, come in original packaging in a complete configuration, and be unused.
4.3. To return the product, the client should submit a relevant application to the e-mail address info@lerson.ee.
4.4. When returning the product, the client should submit the invoice for the product and a warranty certificate that has been filled out, if the client is required to do so.
4.5. In the event of returning the product, the money will be refunded to the user of the Service no later than within 30 days after the application has been submitted.
4.6. The money will be transferred to the bank account from which it was transferred to the service provider.
4.7. Transportation costs incurred in the result of the return of the product shall be borne by the user of the Service.
4.8. If, after the product has been returned, it becomes clear that the product does not conform to the terms and conditions listed in clauses 1–4 of the section ‘Right to withdrawal’, the money will not be refunded to the user of the Service, and the product that has been returned will be held by the service provider. The user of the Service will cover the expenses related to the storage of the product or its return to the user of the Service.
The cost of banking services in the event if the product has been paid for upon its collection from the local post office or to a courier. In this case, 3% from the order amount will be added for the purpose of covering banking expenses (a bank transfer from the account of Omniva to our bank account).
